Expunction.
Expunction of criminal cases are a valuable tool. Criminal records are not like credit reports and do NOT roll off after 7 years.
Prompt Action.
You need to get any accusation off your record as soon as possible or you could lose the right. A conviction for certain offenses such as family violence will prevent any future expunction.
Class C.
I have had several clients reach out about Class C convictions recently. I am posting to show that you can even get convictions off your record if all the right elements apply in Texas. A whole section of the Government code reads:
Sec. 411.0735. PROCEDURE FOR CONVICTION; CERTAIN MISDEMEANORS.
As noted in the section above you cannot have been ‘previously convicted’ which has not been interpreted yet by a court. However, the language should be interpreted as previously means before that conviction not before the request for non-disclosure. Otherwise it wouldn’t make sense.
